The head of the Federal Trade Commission doesn’t want Congress to give the agency broad authority to write data privacy rules
Federal Trade Commission Chairman Joe Simons on Wednesday asked Congress not to hand his commission broad authority to write data privacy rules — a plea that comes as the agency nears a settlement with Facebook amid concerns about the FTC's ability to rein in Silicon Valley.
Firm privacy rules would make it easier in the future for the FTC to dictate permissible data practices to Silicon Valley, and to enact hefty punishments like fines even larger than the $3 billion to $5 billion Facebook anticipates paying in its forthcoming settlement. But it's not yet clear how much leeway the FTC would get to shape such rules, an issue that's emerging as one of several partisan sticking points as lawmakers look to write broad bipartisan privacy legislation.
Energy and Commerce ranking member Greg Walden and Cathy McMorris Rodgers , the top Republican on the panel's consumer protection subcommittee, repeated their concerns Wednesday about giving the agency too wide a berth.GOP Commissioner Noah Phillips also warned Congress against a broad grant of rulemaking, suggesting FTC commissioners should not be able to impose their privacy choices and that rules must remain stable over time.
