The U.K.’s Crown Prosecution Service said the searches would only be requested when it fit within a “reasonable line of enquiry.” But privacy groups are raising the alarm about the potential for unnecessary invasions of people’s digital lives. “The CPS is insisting on digital strip searches of victims that are unnecessary and violate their rights.”working with two women on a legal challenge after they were asked to pass over their devices to the authorities.Given the myriad methods police can gather data relevant to an investigation, the demand to have the physical device initially appears unnecessary.
The legal process, whereby a judge will sign off any request, should weed out the overly broad from the acceptable. Asrecently revealed, tech companies can fight back where there’s obvious overreach, such as the case ofTroels Oerting, a lifelong police officer and former head of cybercrime at Europol, said that police will use many techniques to get the relevant data, but in some cases it was much easier and quicker to get information directly from a victim.
